Preparing for the divorce process

Detective Krakow explains that the basic document presented to the court by the party requesting the divorce (plaintiff) is the divorce petition. This lawsuit should include:

  • an application for a divorce with or without the fault of the spouse
  • parental responsibility application
  • pplication for the division of joint marital property
  • request for the summoning of the witnesses requested by the plaintiff


However, it should be remembered that if the lawsuit includes a request to divide joint property, the divorce process is significantly prolonged.
A private detective suggests that the divorce petition filed in accordance with the jurisdiction to the Civil Division of the District Court in the area where the defendant lives - attach naked relevant documents. The documents are:

  • shortened copy of the Act of marriage
  • abridged copy of birth certificates of common children
  • certificate of income of the claimant


In a divorce petition, it is also possible to request that the defendant be ordered to pay maintenance. The reason for this request should also be properly documented by presenting:

  • PIT for the previous year
  • certificate of current earnings
  • an indication of your monthly household expenses, including electricity bills, rent, etc.


Filing a lawsuit involves costs such as:

  • court fees and expenses,
  • remuneration of attorneys representing the parties before the court,
  • own costs incurred by the parties (e.g. travel to the hearing).


The detective reminds that the length of divorce proceedings depends on whether the plaintiff demands a divorce without adjudication of guilt or with a declaration of guilt of the spouse. In the latter case, proving the fault of the other party requires the collection of appropriate incriminating evidence. And for this reason alone, it is worth considering using the services of a professional detective.
